help about property damage


What is the name of your state? California

I was stopped in my mothers driveway, while sitting in my car, talking to my mom, the neighbors dogs came out of their yard and jumped up on my car trying to get at my dogs who were in my car. These dogs scratched my car badly, during this, I yelled at the neighbor to get her dogs off my car, while she continued to open her own car door. Granted, I don't think she actually knew her dogs were doing such damage, when I told her to get the dogs off my car, she turned around and screamed explicit comments to me. I have gone to get estimates from 2 body shops and have mailed them to her with a letter. She is claiming these are outrageous and wants her dad to fix my car, who is a used car sales man, not a repair shop. I do not agree with this, I think a third party should fix my car. can anyone tell me if they agree. Will a small claims judge agree....I have never done this before, can someone give me some advice? Thank you in advance

My response:

You have the absolute right to have your car repaired by anyone you choose. A judge will give you a judgment for the amount you paid to have your car repaired.

File your Small Claims lawsuit, and when you go to court, bring your Estimates, your repair receipt, your check for payment, and photos of your car damage.

Go get your judgment.

Thank you so much for giving me this advice...I thought I was in the right...this person is really making things difficult, she is also telling people I slapped her in this argument. Of course, this is not true. Also, would it help my case to get letter from other neighbors who have had situations with her dogs as well? One last question...my mother was the only witness and I've read that family and friends are not looked upon as a good witness because it may appear they are trying to help you...please tell me what you think. Thanks again
