Help with minor collision in Florida


This happened in Florida. I was involved in a low speed (less than 10mph) accident where I rear-ended another vehicle. There was a spiderweb shapped crack to the rear bumper on the other driver's car approximately the size of a compact disc, and my car suffered no damage. After speaking with the other driver, he decided not to file a police report and we exchanged information, giving the driver $100 for the inconvenience, which he consented to and accepted. We exchanged information, and I explained to the other driver that I would gladly repair his bumper if he wanted to and informed him to call me. I provided my home number, my work number, my cell number and my address.

The next day, the driver contacted me at work and told me he got an estimate on his car and repairs were to be $900. I told him that the price he gave me was far far too much for having a bumper replaced and painted / fitted and told him that I can definitely get a better price for having it repaired and that I would give him a call the following day. After speaking with my father, who works with cars in a parts department, he gave me some information about a collision center that would be able to get me a good price on the repairs. I left a voicemail with the other driver that day and told him of this information and asked that he call me back with the VIN number so I can call and order the correct parts.

He leaves me a voice mail the next day with his Make, Model and VIN#. I call a collision repair center and they told me I had to physically bring the car in as they never give out estimates over the phone.

Today he calls me at home and tells me he wants $1000 to fix his car in 48 hours or he is going to go into a hospital complaining about his shoulder and sue me for an injury, call his insurance company and the police and in his words "Get me in trouble". I told him that $1000 was an extravagant amount for even replacing the rear bumper on his car and that I would like to see a written document confirming this estimate. He said he had no document to prove this amount and in fact got this information over the phone, saying they told him it would be $650 for the bumper and $350 for an electrical problem which has now apparently surfaced in his car, which he blames me for. His car had no such electrical problems and he drove away just fine from the scene with the front and rear lights working fine. I then told him I can get a much much better price and asked when he would be able to see my mechanic and get an estimate. He said he does not want to go through any mechanic other than his, which has failed to produce a written estimate for the damages, and refuses to bring his car anywhere to have it examined.

I want to fix his bumper, as that is what we agreed on at the scene. I am not hiding or avoiding his calls. I told him I do not have that much money and that repairing an electrical problem with his car was outside of our agreement, as that problem was not present at the time of the incident. He wants me to pay an amount which he has no documentation for, is refusing to take his car anywhere even after I offered to have a tow truck pick it up and return it, and is threatening to sue if I don't comply, as well as going into a hospital and suing for possible medical charges. My license is valid and active, and the vehicle I was driving was not in my name. The owner of the vehicle, my father, is out of the country until March 25th. The vehicle is not insured.

At this point, I feel like I'm getting scammed. He is claiming that now he has medical problems and his car has additional problems, neither of which were an issue the day of the incident, and is demanding far too much money for a rear bumper cover, paint and installation. I don't know what I should do about this, because I'm afraid he'll call me tomorrow saying that all of a sudden he has two flat tires and a dead motor and all of a sudden has vision problems, then calling me the next day saying that he can't walk anymore and his car smells like gasoline, and continuing to make demands which I can neither prove or disprove as there was no police report filed. This happened March 16th and it is now March 20th. What should I do? What can I do? What legal options do I have?What is the name of your state?

Contact your insurance company, and let them handle it. Explain or show proof of what he stated to you.
