Help! Parked Car Hit by Drunk Driver

My b-friends car was parked in front of my home. We woke @ 2 AM to a nightmare scene outside- a drunk driver had hit his car so hard it was in the neighbor's front lawn. Also hit the neighbor's car which had been in front of his on the st. Cars totaled. Polie came & assessed the situation. We did hear them say she was being arrested for DUI. Car in her father's nm, she didn't know if there was insurance or not. His insurance co said if she doesn't have ins. that his $1000 deductible wld be taken from whatever he gets for his car (which isn't going to be much - he had a 98 Saturn!). What recourse does my boyfriend have? I am so angry about this girl-because of her stupidity, his life has to change overnight. I am glad noone was terribly hurt, but it all seems so senseless right now to me!

Your boyfriend needs to submit a claim with his insurance company and provide them with all of the details. If the other party doesn't have insurance, then you can sue them in small claims court for the damages.

If they don't have insurance, and your boyfriend ends up having to sue them, his insurance will provide a lawyer for him (assuming he has the appropriate coverage).

If the insurance company pays on the claim the boyfriend submits, they're going to want to recover the damages from the other driver. Somehow I don't see them just eating the money and not providing a lawyer in court for this...

The insurance will sue them to recoup their money. The boyfriend won't have to do it. They do provide an atty f/ defense though. (I have a feeling you already know this, prob a typo.)
