help please


Florida case. I was hit by a drunk driver he was chrged with DUI and the state attorney wants me to get restitution. Now my lawyer or the case manager to be exact says that all that his insurance is able to give me is 10000 now I have a herniated disc and a bulge on my lower back plus about two months of neck and back pain. The case manager says there is no way to get more than that from his insurance . Are my lawyers just trying to get this over with and get paid or is that all I can get. She said that insurance companies r bound by law to disclose the persons liabilty limit is this true.? Any thoughts?

Florida's minimum coverage for auto insurance is $10,000 for bodily injury, obviously not enough in many cases. You can accept this and use any coverage you have through your auto and/or health insurance or if the person has the assets, sue in court for more than the insurance. A consultation with a personal injury attorney should be on your list of things to do in the near future.

YOUR insurance should be paying your medical bills, Florida is a no fault state. Do you have any permanent injuries? If you only had pain for 2 months, I'd say you don't. Without permanent injuries, you get NOTHING for pain and suffering.

Insurance companies are NEVER required to disclose policy limits unless a lawsuit has been filed and is in the discovery phase. Sometimes they do disclose voluntarily, but usually only if the case is clearly over the limits and they are offering the max. If the limits are 10k, that's all they are required to pay, ever. Getting a judgement for more will be difficult, time consuming, expensive, and likely pointless since he probably doesn't have any assets anyway.

help please..


when I said pain for 2 months I meant 2 moths and counting... the herniated disc sound slike a permanent injury to me.. but thats just what the doctor said... now I just want ot make sure that my lawyer is not trying to get this over with quickly and get paid... as long as thats all they can get thats fine by me... what do I do about the restitution.??? what can I file... and is there a time limit to file??? I got the letter about 2 weeks ago... and I should send it in pretty soon...?? thoughts?
