Hit from behind


What is the name of your state? ALABAMA
While exiting from Walmart's access road onto Hwy.72, I was waiting for the traffic light to change and was bumped from behind by a 16 yr.old driver. I called and the Police came and made a report. She admitted total fault to the officer and he described it in the report. He also noted in her column "UNATTENTIVE DRIVING". He said it was a Private property accident and that we should each take a copy to our Ins. and let them handle it from there. I waited 2 weeks and never heard from anyone so I called the girl's Ins. Broker. She a report had not been turned and asked me to fax her a copy which I did. After contacting both the Broker and the girl's father several times, I'm getting the old run-around. The estimate for repair is only $552.00. My Ins. agent says they will fix the car but my deductible is $500.00 and it's not worth it for them to try to recover such a small amount. Is my only option Small Claims Court?

Does the Insurance Company have any obligation to me to try and collect my deductible for me?

I don't know if there is an obligation, however, if all they would end up paying out is 52.00, then they are not going to waste their time and resources for that small of an amount.

I'd continue to try and work with the other persons insurance company, and if that doesn't work, then go to small claims court. Maybe even try sending the person that hit you a demand letter prior to filing in small claims.

I thank you so much for your responses.
How do I sue a minor in small claims in ALABAMA? I can't find any specific info on it. How do I send a certified request for damages and intent to sue? Do I address this to the 16 yr. olds parents, to the minor or both? Thanks for any help you can give.
