Hit from behind while stopped for School Bus


What is the name of your state (only U.S. law)? Pennsylvania
I was driving my mothers car with her permission and her insurance. I have no car. I came around a bend and saw a school bus with yellow lights flashing. I stopped and was hit from behind. I was unable to obtain info from any witnesses. A man came up to my car, said he saw I was at a complete stop and then this guy hit me from behind. I told him I was injured, call an ambulance. I heard him give his name to 911 that he witnessed it. I know the school bus driver and a women standing along the road saw it. I was rushed to local hospital and life flighted to a trauma hospital. The police officer came to the first hospital ,left minimal info. Waiting for call back today. I had prior surgery 2 years ago for a kidney auto transplant and there was concern I damaged the kidney. I also had trouble breathing, my left shoulder is hurt and I am in a neck collar due to neck pain, which is currently being determined as to extent. I am quite sore. I found out last night her car has a few scratches on bumper and a bent steering wheel from me hitting it, which I did not know nor did my drs. the insurance company wants me to contact the other parties insurance to open claim and was told they will want extensive answers concerning medical problems. Do I have to answer all thier questions at this time? I do not know the extent of my injuries nor total damage to car. Can I refuse to answer until I talk to an attorney? Do I have to allow them access to my medical records now or can an attorney handle that? Also, I am on SSI disability due to the kidney auto-transplant and some other medical issues. Does that make a difference? I know no one else was hurt and was told his car was totaled, though the latter I do not know for sure yet.

The ad that runs on the local TV station says: "Don't sign anything until you talk to an attorney".

That sounds like good advice to me.

The fact that you were already disabled will affect your claim to some extent, there are no lost wages that you will be able to claim. I would definitely advise you consult a lawyer first before doing anything else - your injuries are severe and complicated by pre-existing conditions.

No you don't have to answer their questions at this time. But if they need information from you to complete their investigation and you fail to supply it then it could delay the processing of your claim. If you have prior health problems or prior accidents they will want to review your prior medical records and if push comes to shove can refuse to evaluate your claim until you supply this info. Seems like it too early on to worry about it. Concentrate of getting the treatment you need to get better.
