Hit by a Commercial Vehicle


I live in Chicago, Illinois and was hit by a commercial truck the other day while stopped as approching a toll booth. Guy obviously didn't see me and was trying to change lanes, moving only 3 mph. No injuries but looks like a couple thousand $ damage to my car as he tore up the drivers side rear quarter panel and driver door - Of course truck is just fine. He got a ticket for no proof of insurance and for accident (although trooper never said exact nature of ticket). Managed to find company the trucker works for and it appears he does have insurance. They said they would get the report from the driver and pull the insurance info and get back to me.

Now, since I only have liability what happens? My insurance doesn't have anything to do with it. He didn't admit fault. The idiot kept saying I pulled in front of him - although I was stopped and I think the damage shows that he is at fault. So I doubt his insurance will just pony up. The court date isn't for another month - and I don't even know if that does anything. The trooper said it was just a traffic violation and that the damage is a civil matter. Is his company liable, or is it the trucker, or the guy that owns the truck - which is just some name on the accident report.

Since there is no personal injury, do I need a lawyer or am I just going to pay more than the damage is worth in fees to have him pay - MAYBE, that is if he is found at fault.

What are my options? Any advice?

Be certain to fully document the damage.
Any witnesses?

Several items mentioned in your post may give some direction on whether or not to retain a lawyer -
1) The response of the company's insurance company.
2) The outcome of the traffic court proceeding.

It would probably be advisable to at least have an initial consultation with a lawyer (lawyers who provide free initial consultations are pretty easy to find) to evaluate your position.
