Hit be a driver(suspended license) that ran the red light


What is the name of your state?
Mississippi student

I was involved in a car accident with a man that was driving with a suspended license and no car insurance. I drive a 1996 Nissau Sentra.I was waiting for the light to turn green at a cross section. His light was red. He was suppose to stop. My light had turned green. When the light turned green I pulled out to make a left turn. He didn't stop at the red light his car kept coming. The car ended up hitting me on the driver's side back tire, damaging the driver's side back door. When he hit me, my car turned around in the road and I ended up on the other side of the road. He pulled over where I was. I got myself together and got out and asked why did you run the light. He started saying that he didn't run the light. I called "911". He ended up going to jail. I have insurance. I have filed a claim with my insurance company. Will I be able to sue him to pay for the damages to my car?

You can sue anyone for anything. Depending on the police report your insurance would sue him for you. (If you have full coverage). If he was going straight and you were turning and the light was just green (with no arrow) then it would be your fault the way I am reading this.

Did you get a ticket?

Anyway, yes you can sue him but, depending on the state's negligence laws, you may or may not get full damages. (You were in his lane of traffic.)

If he doesn't have any money, he is "judgment proof" meaning a civil judgment won't affect him one way or the other since he has no assets.

driver didn't stop at redlight

No, I didn't get a ticket. I thougt when the light changed to green and the the light change to red for others, they are suppose to stop and you can go. Plus I waited for a minute after my light turned green to make sure. He speeded up for some reason.

east and west lights could both be green. To turn you would need an arrow or use caution. I think this would be your error.

I was going east getting ready to turn north. He was continuing straight going south. He was to my left. I had to wait until my light turn green. There are no arrows involved. It doesn't matter whether or not I was turning. I could have been going straight across to the other side of the road. The point is his light turned red. He was suppose to stop and wait. He didn't. He felt like he could continue heading south. He failed to follow directions. We were not even on the same two lane road. I was on Spring street at the red light. He was on Main Street at the light. Before he got to his light it had turned red. My light had turned green. He was suppose to stop at the red light whether I was turning or going straight across. Instead of him stopping. He speeded up. If he would have stopped at the red light, there would have been no accident.

I think people weren't realizing that you meant you were hit from the side, not from oncoming traffic. If he were coming through oncoming traffic, then technically you were at fault because you're suppsed to wait behind the stop line when waiting to make a turn, which means you shouldn't have turned when the light went yellow. But that's not the case here!

The other driver is entirely at fault in this situation. Your insurance company will pay the claim and you need to sue the driver in small claims court to get the damages back, including your deductible. Your insurance company should be providing a lawyer for you.
