Hit in a Parking Garage


What is the name of your state? Illinois

On October 24, 2005, I was in an underground parking garage in Springfield, Illinois. I was driving around the garage and noticed a car that was preparing to back up. I stopped my vehicle and the car backed up into me damaging the front of my car. What I suspect is that the other driver was just going to back up enough and then go through the exit instead of going around the one-way circle.

Again, she backed up into me. We both got out of our vehicles and she claimed it was no big deal and that we should both go on our merry ways because she was already late and she would just give me her insurance information. Well, I have always been taught to call the police and get a police which I did and she through a fit about.

Later that evening, I was feeling quite a bit of pain and went to the local hospital where I had numerous ex-rays, was put into a neck brace, and had some other testing due to the pain I was having in my legs, lower back, and neck. I left the hospital with no serious damage besides muscle strain and an order to see my family doctor.

A week later, I went to family doctor who ordered me 2 prescriptions (which I completed) and 30 days of physical therapy. I did not feel that my pain at the time was serious enough for physical therapy and would cause even more of a hassle. For the last month or so, I have been in great pain still in my lower back and neck and went back to my doctor. He gave me refills for the two prescriptions and said that I must go to the 30days of physical therapy which I have scheduled to start next week.

As for my car, her insurance totalled it and gave me the option of taking $1575 and they'd take the car or $1375 + keeping the car. I took the money and kept the car. This was more than reasonable considering I thought I would get less. It took more than 2 months to get this and I was given the run around with her insurance.

I want to make sure that I get what I deserve for the pain I am in and don't want to be cheated by her insurance company. What should I do? Do I even have a case? Should I get a lawyer? or what?
