Hit & Run


What is the name of your state? Texas

I was involved in a minor Hit & Run accident (about $2,000 damage). The other driver was at fault and did not stop. I filed a police report and they were able to locate the person and get their insurance information. I filed a claim with there insurance in October '03 and they continue to state that they are unable to contact their customer to get a statement and therefore will not do anything with the claim. It is a small insurance company and i find it hard to believe they can find their client to get payment but not to get information about the accident.

What are they required to do to contact their client and is it required that they have a statement from the client?

I am considering sueing them in small claims but can I request documentation of how they have tried to contact their customer to make sure they have made attempts?

You can't sue the insurance company for your damages, they were not involved in the accident. You will have to sue the driver of the vehicle, this person will then tell his insurance company and they will provide his legal defense and pay any claims up to the policy limits if their customer loses the court case.

Sorry i meant i am considering sueing the driver. I did not realize the insurance company would be responsible for paying the judgement but that does make sense.
