Hit and Run


What is the name of your state? Kentucky

8 weeks ago, my husband was the #2 vehicle in a 4 vehicle hit and run. Vehicles #1,2, & 3 were at a complete stop waiting for vehicle #1 to turn left. Vehicle #4 rear-ended #3. #3 was pushed into my husband (#2) and our vehicle was pushed into #1. There was significant rear-end damage to #3, very little damage to our vehicle, and (according to the owner) $1400 damage to vehicle #1 (owner has a $500 ded. and feels as though she shouldn't have to pay it). The police report states that it was a hit and run and that none of the other 3 vehicles were at fault (all were "stopped or stopping" when hit and run occured). The owner of #1 called and said we have to pay the $1400 worth of damage to her car or she will go to the county atty. We have insurance but since there was very little damage to our car, we didn't process a claim (although the insurance company knows about the hit and run). The owner is also claiming that NOW she has a witness that will say we were at fault and that she's going to get the police report changed. Can she actually do all this (change the police report and make us pay)?

I wouldn't worry about it. Your insurance company isn't going to pay her anything, and no judge is going to rule for her. I very much doubt she has the resources to have the police report changed (not that it even matters since it's not admissable in court!).

I thought she COULDN'T do anything about it but I also thought she WOULDN'T either. Now 2 months later, shes making rude phone calls. I just wasn't sure. I was out of state when it happened although I read the police report and it says everything that my DH told me. Since she hadn't said anything up to this point, I had forgotten about it. I just got kinda worried not knowing how insurance companies deal with rear-ending even if it was not our fault. I was always under the impression that if you rear-end someone (regardless of the reason), it was your fault. We never contacted the guy that was behind my husband. There wasn't any reason. He hit our trailer hitch and it messed up his bumper alittle but didn't do anything to ours.
