Hit and Run

What is the name of your state (only U.S. law)?
CALIFORNIA

I got rear ended a few weeks back and the guy took off. I got his plates (out of state) and filed a police report. Today i got a call that they got a hit on the description and license plates. I don't have collision coverage, only liability and uninsured motorist. My car is still drivable but it looks pretty bad. NOW that they got a hit on the license plates I was debating if i should get a rental and then file a lawsuit against the other party for the bill. Am I legally able to do this?

If your car is driveable, then you need to keep driving it until you put it in the shop. There is no reason for you to get a rental if your car is not being repaired yet. You should get the other person's insurance information and file a claim with them.
