hit and run on a bike/ driver not charged

my lover was hit last thursday evening by a car while riding her bicycle home from work. The driver of the car never stopped. By the time the police got to the scene, the fire and ambulance crews had removed any evidence. She had her ankle run over and completely smashed. The police called her today and said they have the name of the guy and his insurance info but no citations were issued due to the lack of evidence upon their arrival. What options does she have now. I thought leaving a scene of an accident no matter who was at fault was illegal. At the very least I would hope she could have his insurance pay for her medical bills. Should she retain a lawyer or is there nothing she can do.

My response:

Your "lover" should immediately hire an attorney. The police must actually see a felony happen, if there is no extrinsic evidence at the scene or damage to the car that matches other known damages, before they can make an arrest on "hit and run" charges. Now, it's only a matter for the Civil courts.
