Hey guys...so here is the scenario:
i live in newport beach, california. as much of the parking outside of the homes here in newport beach is street parking, my vehicle was parked LEGALLY out on the street. there was not yet insurance on this vehicle, and because of that i was not driving it.
so this is what happened...a girl hits the car, knows that she hits the car, and drives off because she is scared. she didn't leave a note, or make any attempt to take responsibility for the accident.
2 witnesses saw her hit my vehicle and wrote down her license plate, desciption, etc and i take that into the police...the police knock on her door and she admits to the hit and run.
to make a long story shorter, this is where my question is....
i don't necessarily want to file an official police report as long as my vehicle is repaired...however, when i talked to the police officer he told me that IF i did want to file a proper report that i would be given a violation for not having insurance on my vehicle in accordance with 16028 (c) which could be up to $1,400. this violation has something to do with uninsured vehicles involved in a motor accident.
my question is...can i really get a fine for having an uninsured vehicle parked on the side of the street legally when nobody is driving it?
i was under the impression that it was only illegal to DRIVE an uninsured vehicle.
