Hit & Run in a parking lot


What is the name of your state (only U.S. law)? Massachusetts.
My car was damaged while parked in a private parking lot. The landlord is the same one who owns the building where my workplace is. There is no access control, and the landlord says that, while it is not posted, I park there at my own risk. Can they avoid liability that way?

A: Yes, unless they are the ones who damaged the car.

For reasons such as yours there is insurance ~ have you called your agent or company?

Yes. I have insurance, but I wanted to know if the owners of the lot had any responsibility in that circumstance. I strongly suspect the contractor used to plow the lot, but have no witnesses. Therefore, I have to pay the deductible. I'm out a lot of money to repair damage caused by someone else.

No, the owners of the lot have NO liability. They can't control the actions of the people who park there any more then you can. The only person liable is the person who hit you. Just because you can't identify them doesn't mean you can transfer the blame to someone else.
