how to fire a lawyer ?


What is the name of your state (only U.S. law)? south carolina
my wife was invalved in an accident in jacksonville florida in2007 she was hit in the rear at a stop light.she receaved a back injury so when she got home to hampton south carolina we went to talk to a lawyer and told him what had happened and he said he would take care of it and sent my wife to a back specialist.she has sence ben to another doctor and phisical theropy.we never can get the lawyer to tell us anything and just two months ago he told my wife he would have to get a lawyer in jacksonville to file a law suite for us because he could'nt. now the lawyer told us we should call the lawyer in jacksonville to find out what is going on so we did.the lawyer in jacksonville said they could not get the lawyer in south carolina to send any info and when my wife went in this morning to set up a meeting they did'nt even know who was handeling her case.the lawyer in jacksonville said he could not do anything untill the gat the info so my wife is having to get all the info her self.
my question is can you fire a lawyer and how?

You should have gotten a lawyer in the correct state way back when. You can fire your current lawyer but you still have to pay for the time and expenses he has spent on your case. When you find the lawyer in Florida, you can ask what you need to do to get your old lawyer off the case; he will probably file a lein on your settlement so that he will get paid.

The lawyer in SC shouldn't have said that he would handle the case.

The Lawyer, or A lawyer, in Florida will send you a paper to fill out naming him as the lawyer who is now handling your case.
You will tell, and bring the note to the old lawyer. He will give you the records that he has, and you will forward them to the new lawyer.

Normally, since he did nothing but refer you to a doctor or doctors he shouldn’t charge you for doing nothing.

You will also have to fill out releases for the new lawyer so he can make sure he gets any and all treatment records.
