how much punitive damages to seek?


What is the name of your state? Pennsylvania

OK, bare bones facts here: morning of July 12, out-of-state moving company truck blew through red light right in front of me at 2:20am (I've driven this road at this time of night a few times a week for 5 years; he's not from the area). no time to react, I slammed into his diesel tank, nearly flipped truck over (carried full load in back). I was doing approx. 48 mph in 45, unknown speed of truck (more than 30 I'd say). truck driver is 100% at fault, thanks to 6-8 witnesses who saw the whole thing at nearby gas station. brand new Stratus sedan, just two weeks removed from getting it back from $6,000 in repairs thanks to another red-light ignorer six weeks prior (WHOLE 'NOTHER STORY!), totaled (thank God for GAP insurance!). driver denied having red light at scene (I suspect he fell asleep at wheel). I was taken to ER on stretcher, X-rays on left leg negative, severe bruising on left shin, right elbow, left thumb, various scratches. EXTREME emotional and mental stress, not just from having gone through 2 accidents in 6 weeks (both were 100% fault of other driver) but what to do about car/financial situation now? I work full time and go to school full time as well; the stress has been overwhelming. my family came to get me at ER and assured me we can sue the driver and his company for a lot. I want to hit this company for everything they got, but realistically I'm not expecting much, especially after reading some of these posts. can I at least expect a significant settlement? say 50-100K? I hope and pray I can get a new car and relinquishment of personal debts out of this horrific experience. Thank you for your response.

You had better TRY to get a good personal injury / auto accident lawyer and quickly. Handling this on your own assures one thing -- you will be screwed a second time. But good lawyers may not want to handle this as there does not seem to be a major possibility of recovery.

For that one has to suffer substantial personal injury -- something disfiguring, causing loss of income or function, causing pain and suffering and that is rather lasting -- otherwise don't expect much. And forget punitive damages.

Damage to a car entitles you to the value of the car or repairs. It does not entitle a person to significant damages for pain and suffering.
