I feel my rights have been violated


What is the name of your state? SC


I was in an accident and had to be taken to the hospital. While at the hospital, I was taken to have some test run. I was given some kind of medication that impared my thinking. None the less, after the test were complete I was taken back to the ER still strapped down not able to move. In walks this policeman. He starts questioning me about the accident. I remember being a little confused about a couple of questions he asked but answered them the best I could. At one point he asked me if I owned the truck I was driving and I told him it was my mom's. He then asked me who it was insured with, to which I said, I think it was State Farm. The officer got rather rude and said "you think!" I said yes, but that the insurance card is in the truck. To which he replied, "well, alot of good it is doing me here." What a real jerk. When it was all said and done. I was put as being as part fault in the accident, which is crazy at best. There is no way I could have been at fault. The driver who caused the accident was in the on coming traffic and came across a four lane highway and into my lane. Hitting a van in front of me and causing that van to hit me.

If the rude officer wasn't enough, I had wondered why my husband had not gotten to the hospital yet. Come to find out he was there but was just not allowed to come back to me. I don't get it this officer who I feel like violated my rights, in first being it the room without my permission, asking me question when I had just come from having had medication given to me that impared my thinking, and the hospital refused to let my husband back to me. There was no reason he shouldn't have been allowed to come back to me as I was just lying there waiting for test results.

Oh yeah, I almost forgot the 911 service hung up on me!!! The guy with told me I needed to tell them more about where the accident happened. I was telling him the best I could tell him. He asked what is around you, to which I said nothing, it was all trees. While asking some of the others around if they could tell me more about where we were they said the same thing I had already told the 911 operator. While I was asking someone else it they could tell me more about where we were, the 911 operator said I'll just have to wait for someone else to call and hung up!!!!!

Somehow I think that county has some serious problems with leadership. I don't in the county where the accident happened but live in the next county.

The accident was bad enough, but add 911, the officer and the hospital on top, it made it a nightmare. I feel very mistreated and that my rights have been violated.

What should I do or is there anything I can do?

I don't think your rights were violated but if you were not competant to answer questions you may be able to get whatever you told the officer thrown out, if it ever comes to a court situation. If the accident was not your fault and you are planning on pursuing an injury claim against the at-fault driver, then you can hire a lawyer and ask what he/she thinks about the situation.
