What an appropriate user name.

I was driving on an insurance policy that had lapsed some time ago. Poor judgement on my part, no argument there. To make matters worse, a young lady rammed my car and caused substantial damage. No one was injured (fortunately), but several witnesses can verify the fact that the accident was not my fault--she was wrong for pulling out from stop sign while I had the right of way.

1.) Does her insurance company have any obligation to repair or pay for the damages to my car?

2.) Should her insurer pay me for a rental?

Again, I recognize the STUPIDITY of what I did (drive w/ no valid insurance) but does that clear her and her insurance of any obligation in this case?

How about telling us your state; it would make it easier to respond.

Sorry about that.

While the laws vary with each state, generally, she and her insurer (assuming she has insurance should be liable for your reasonable damages from the accident. This generally includes the repair costs (if car not totaled) or fair market value and other reasonable outof pocket expenses. This might include rental for a short period of time. To get the law as it specifically applies to all your facts, it would make sense for you to consult with an attorny in your state.
