In February of 2000 I was a passenger in a serious car accident. I was knocked unconscious for about five to ten minutes. The driver of the car I was in took 100% responsibility for the car accident. Unfortunately, I had to sue. Her insurance company wasn't paying the bill when I sent them in and I was about to be put into collections.
I spent well over a year trying to recover I had appointments with a massage therapist, chiropractor, osteopath, neurologist, and acupuncturist. Towards the end of my treatment my lawyer decided to settle. I was only seeing the chiropractor two - three times a month and the massage therapist once a month. At the time I felt better, not completely well, but I could do life functioning skill with out a great deal of pain.
Getting to the point, I am not well. I still have to see the chiropractor, and my body goes through relapses where I can hardly function. Walking is extremely painful and I suffer. Looking back I was young and I was just happy have everything done with and nobody told me I should wait until I am completely well or even inform me that my future medical bills could be covered if my lawyer would request it. My lawyer put in for a settlement and asked for 35,000 his assistant told me that was a mistake and they lawyer had "low balled it". Needless the insurance company jumped at the opportunity and within 24 hours they had sent in the paperwork and a check. 16.5 thousand of which I got for myself. Do I have any legal standing? Can I go after the insurance company again? Can I go after my lawyer? I am only 22 and very sick of being in pain all the time. Any advice would be greatly appreciated.
