I rear ended someone...


What is the name of your state? North Carolina
So a couple hours ago i was driving home and rear ended someone. It was a strange situation. We were driving over a bridge where there happened to be a number of migrant workers fishing and the driver of the other vehicle stopped (i think to talk to them) and by the time i realized what he was doing i couldn't stop. WHAM! There were no injuries and all the migrants scurried away as they realized the cops were on the way. I was given a citation for unlawfully operating a motor vehicle without decreasing speed as necessary to avoid colliding with a vehicle (G.S. 20-141(m)) It just so turns out that it is illegal to fish from the bridge. So im wondering if i am at fault because the accident as described by myself and the other driver was because of the migrant workers breaking the law. It seems like i broke the law because others put me in the situation to break the law. I have no idea if that holds any legal water but that is why im asking. Also looking over the citation the police officer wrote down my licence plate number incorrectly. I have often heard that people get out of tickets because of this, is that true? Thanks

even if the others were breaking the law, it did not affect your poor driving skills. You are solely responsible for hitting the other car due to your error in judgment. If you wre paying attention, you woudl simply have been able to stop before hitting the other car.

Is your name and license on the ticket? You were driving. Your car may be able to avoid a ticket due to the inaccurate plate but you still get yours. (It's a joke son)

The incorrect plate will not excuse you from your liabilities.
