I WAS VISITING A LOCAL THEATER AND AFTER STEPPING OFF SIDEWALK ONTO THEIR SMOOTH FLOOR I FELL...I WAS RECUPERATING ALREADY FROM 2 BACK SURGERIES...I ALSO HAD 2 PREVIOUS CERIVAL SURGERIES...THIS FALL AGGRAVATED MY BACK TO A WORSE LEVEL...ALSO THE FALL LOOSED A SCREW IN MY NECK AND PULLED SOME HARDWARE LOOSE FROM PLATING...I HAD TO HAVE SURGERY TO REMOVE HARDWARE...THUS MORE PAIN...I AM STILL TRYING TO GET BETTER...DO I HAVE A CASE FOR A LEAST PAIN AND SUFFERING?...

With the facts as represented, you probably are entitled to be reimbursed for pain and suffering, medical bills, and lost earnings. They will also be liable for any damages attributable to aggravating your preexisting medical condition.

They will probably try to reduce by the % of your comparative negligence. They may assert that you weren't watching where you were walking, and/or that you were wearing "slippery" shoes.

hey again...


i am in ky....and i am disabled and drawing social security disablity due to my back and neck condition....so no lost wages i guess....however i was going to try to work 2-4 hours a day part-time somewhere...now no way can i do it!...thanks for replying elliot!

Make an appointment with an attorney in your area. There should be little or no charge for the consultation. This type of case is usually handled on a contingency basis.

This is so weird, My name is Kym too, and I was injured in a slip and fall. Seeing your name and your subject forced me to immediately investigate. Now that I know for sure I'm not in the "Bermuda Triangle" {after reading your incident). I can wish you good luck with your case and lots of extra strength vicotin for your pain!!!
