I think i'm getting the run around??


What is the name of your state? oklahoma
I was involved in an accident in a Loves parking lot on Aug 2nd 2003. A guy was trying to exit thru the entrance of this parking lot and hit me on the passengers side as I was entering the parking lot thru the entrance. There was a car in front of me that was turning to the right. After they had started turning right I proceeded to go straight to the parking lot in front of the store. I called the police and they wouldn't respond because the accident happened in a private parking lot. He said, "that's a matter for the insurance companies to handle". It's been 42 "business" days since the accident. The insurance company still has not made a liability decision. I spoke with them today and they are saying that I am 35% responsible for the accident. I asked them how they could come to that conclusion. They said that the lady in the vehicle that was in front of me is stating that I passed her (pulled around her) before she had turned and in turn made me partially responsible for the cause of the accident. My question is this...since the "entrance" is clearly marked as an ENTRANCE, why would it even matter if I were to have pulled around this lady or not? Which by the way I DID NOT!!!! The lady in front of me was diagonal to the curb before I started to go straight. Simply put, this accident WOULD NOT have happened if the guy would not have been trying to EXIT thru the ENTRANCE! I think the insurance company is trying my patience in hopes that i'll accept what ever offer they throw out at me. It's kinda like a one way street isn't it??? I mean, signs are posted for a reason and when people disregard those signs and cause accidents they should be held fully responsible, not partially responsible.

Yes. I thought that garbage dump of a "restaurant" business went out of business years ago?

Anyway Writer, as you can see being "penny wise" is being "pound foolish". You can't handle this on your own because you don't know what you're doing.

Hire a personal injury attorney.

I appreciate your response IAAL, but I was not injured in this accident so an injury attorney would not be very helpful. I was hoping for some insight as to what other alternatives there are. I've contacted the Insurance Commissioners office and will be starting the Arbitration process shortly. I am curious as to your take on the responsiblity of the person who was using the entrance as an exit.
