Is it illegal to...?


California:
Does anyone know if it is illegal to make flyers stating a company is doing Bad Business and then passing them out or mailing them to people in the city.
On march 7th a Long Bed tow truck backed into me at a red light and after he refused to give me his info. he told me to wait for his boss ..That his boss had his info. (insurance , Lic# etc.,) and he was on his way. well I had two kids in the car and these two guys were burly men and I felt totally intimidated and his boss came out and said, "well there's not that much damage so I see no point in making a report..here's my business card. Just take care of it (the damage) and send it to me." I said , : Don't you think we should exchange information." ..He proceeded to get louder and said NO theres my card just send it to me..
Needless to say I gave them the benefit of the doubt..( I know I"M AN IDIOT!) I had no choice.. So two days later I took over the estimate and I got a phone call from him 2 hours later saying, " I'm a little confused why you brought me the estimate..seeing it was your fault".. I about hit the roof! ANyway, I've made a policereport, contacted my insurance, called The Automobile club (there logo was on the truck) and I want to make some flyers and pass them out/mail them to people in the city where this took place. I plan to tell everyone I ever come into contact with not to do business with this company, but just wanted to know if he can sue me or anything for doing this.

Let's set the legality of distributing possibly libelous material aside and look at actions more likely to produce desirable results(for YOU).
Was this a commercial vehicle? It sounds like it but I don't want to make assumptions...
If the driver didn't have his license, and insurance info on his person or in the truck,something doesn't smell right...you may want to contact the local DOT office and report this. You also might want to contact your state Attorney General,and also contact the police again if you haven't already. It sounds to me like this is an unlicensed driver at the wheel of an uninsured truck-and most likely the driver should have had at least a CDL B license. The business owner("boss") is trying to not get caught.breaking any number of laws and DOT regs-who was or was not at fault in the accident has no bearing on a commercial vehicle being operated with an unqualified driver and no insurance. Tell YOUR insurance co what's going on...
If this outfit is running trucks that are not driven by qualified drivers and covered by insurance, you can put them out of business without making a trip to Kinko's
