| I live in South Dakota but was in Key West Florida in February on vacation. The first night I was in Key West I went to the Rick's Cafe American dance club. The club is a split level-the dance floor is on the lower level. You must walk down 6 steps to reach the lower level. At around 8pm, completely sober, I reached these steps and could not see where the first step was due to it being so dark and people were standing on the steps. I held on to a stranger and put out my left foot on what I thought was the first step. It was actually the second step, I slipped on the step and fell down the entire flight of stairs. At the time it bruised and swelled immediately. No on in the club came to help me though the bartender had a clear view. When I returned from vacation I found out that I broke two bones in my foot, mangled the nerve in the foot and have reflex sympathetic dystrophy in the foot due to the nerve damage. RSD is permanent in 60% of cases with permanent chronic pain. It is July and I am still attending physical therapy twice a week and am on pain medication.
Should I sue the nightclub? Should I write the nightclub about my problem or should I just hire an attorney?
