Three years ago my husband and I were stopped at an intersection and the vehicle behind us was not paying attention and hit us. The impact caused me injury to the C5-C6 discs. To date I continue to have pain in my neck that will radiate into the shoulder/arm area and up into the left side of my head just behind the ear. I am still under doctors care with her suggestion of surgery. Before this time I did have some medical history of headaches which were always described to me as muscle tension. I have never had a neck injury. Today I was at my attorneys office preparing for tomorrows deposition and he said my history of previous headaches is definitely going to come into play here and will hurt me. My argument is that Im not claiming headaches. Neck pain will radiate to that point as well as my shoulder and arm but I never get a headache unless it begins with neck pain. No where in my records is there a complaint of neck pain. This deposition makes me nervous because I feel it's going to center around me having a history of headaches. Is there anything I can do?
The best thing you can do is heed your attorney's advice. Beyond that, volunteer nothing and answer all of the questions honestly to the best of your recollection. Good luck!
