A plumber dispatched by a franchise of a nation-wide company to our home to repair a clogged drainpipe. The plumber had to initiate the repairs on the roof of our house. The equipment he needed include a 400 pound "snake" machine. The technician asked the son of the owner of the house to help him lift the machine onto the roof. The only incident getting the machine up was a bump on the head to the son. However, when the son and the technician were taking the machine down, the technician who was on the roof, lost his grip and the son, unable to hold that much weight, lunged out of the way. The machine struck the standing ladder about mid-way, causing the ladder to catapult in the direction of the owner of the house who was standing beneath the eave in the porch area. The 66 year old woman was struck violently in the head by the ladder and suffered a one inch long contusion on her forehead which required paramedics and transport to the hospital emergency room. The injury to the woman was very substantial. There was a great deal of blood loss. This occured on Friday evening, and here it is Monday morning and she looks much worse than before. She has missed 4 days of work so far and inevitably will carry a scar on her forehead for the rest of her life. Was the employee displaying negligence by using her son to complete his duties which resulted in serious personal injury? What advise does anybody have?
