Insurance


What is the name of your state? Indiana

Is it true that you can not sue your own insurance company. Trying to settle claim and thier low balling me.

My response:

It's true, and it's not true - - I'll explain.

In most instances of Uninsured Motorist coverage claims, your resort is to the Arbitration process pursuant to your policy.

However, in egregious situations; e.g., denying coverage when, in fact, you paid for coverage, then you can resort to a "Bad Faith" lawsuit.

But, all because the insurance company isn't seeing eye-to-eye with you on the "value" of your claim, then your resort is to Demand Arbitration.

Read your policy for details on how to make such a claim, and then discuss this matter with a Personal Injury attorney for the laws concerning such a claim.

Just wanted to know if Arbitration is binding or non-binding.Do I have a choice to which one i want to go with. Thanks for all your help

My response:

Uninsured Motors claims actions are binding arbitrations. Whatever the arbitrator's decision is, then that's it. It's over.

Insurance


Once this is set for Arbitration can the insurance try to settle this before the hearing.
