I live in SC I was offered an insurance claim on a wreck my daughter was in(she was a passenger)I was told I needed to go to the court house in my county and be made consevator because my daughter in a minor,the probate judge told me the the mother,my ex wife needs to be notifed of this settlement and that she has the right to the money too unless she signs a waiver.Is there anyway around this?Can I wait till my daughter turns 18 in sept.and just let her collect the settlement herself even though she was a minor at the time of the wreck? Would my daughter then be legally libel to pay back the med.bills?
