insurance co. backing out


What is the name of your state? Michigan
we recently purchased a 2003 Cavalier (Dec.) The folowing night our son...who does not have a license...took the car went out drinking and put the car in a ditch. Called insurance agent who said no prob. Adjuster came out, talked hubby into totalling it. They came and got car....had us sign off title. Claim not settled-they are now "investigating" trying to say our son was in the home when we opened policy (fraud?). Our son has been in and out of jail and our home for the past 6 years. Of course this has always been his home address even when he isn't here. He had been living away and just moved back in Nov.
What can we do? they have our car AND title to it...we have the payments.
Help!

I really cannot believe you are asking this. There is nothing you can do except keep your kid from driving.

Just whose fault do you think it is?

If your son was living w/ you at the time of the accident he is required to be added on the policy unless you get an exclusion. They could very well deny your claim.
