Is insurance company on my side this time?

I live in CA and was involved in a car accident in a car that was rented under my name. However, I was not the driver.

I let a friend (who was not on the contract) drove the rental car knowing that he did not have car insurance, thinking it was alright. Unfortunately, he wrecked it, and it was his fault. To make matter worse, the rental car did not have LDW coverage from the rental car company either.

Do anyone know if I will be financially responsible for this accident or would my friend be? My insurance company is asking for a recorded statement from me, should I give it? Other passengers were also asked to give a recorded statement, are they required to give their statement?

I am not sure if the insurance company is on my side this time. Any advice would be appreciated.

Generally the rental agency

provides insurance on their own vehicles.Everything depends on your signed rental agreement so read it.Does it say you must provide ins coverage on their cars?

yes it does. it is covered by my insurance if I am the driver. I am not sure if my insurance will cover someone else driving that rental car however.

NO it wont cover the driver of the car ONLY if you were driving.

so you are In a ton of trouble Boiiiii!

Of course you can sue your friend as he is responsible for reimbursing YOU.

But YOUR name is on the contract and YOU will owe the money!

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Rental Car

The fact that your insurer is involved indicates they are working on this, and I think they are on your side. You do not state why you had to rent a car.....it is possible that the insurance contract has provisions (I am not familiar with your State). If this qualifies
as a temporary substitue, and the fact that your friend was a permissive user, it is possible they will pay for this one. Cooperate, you don't have much to loose in my opinion.

I think Donna is correct

Your problem depends on both your rental agreement and your ins co policy. As Donna said permissive user allows you to let someone use your car like a friend but not family and they are still covered in your vehicle.I dont know if this extends to rented vehicles so you need to check out all agreements.
