Insurance company wants to use a Used Quarter Panel on '2002 Honda Accord....


for repairs. I as well as the shop dont agree with the Insurance Company, furthermore the Shop tells me that they have never been asked to use a Used Quarter Panel instead of a Dealer part from Insurance when it comes to that panel. The Insurance Adjuster refuses to allow a new Quarter Panel to be used, and insists the shop use a used one. The shop is Korean-owned and the adjuster also mentions the fact that Korean bodymen can do anything to repair a car, and that they should be able to do it regardless if its new or used. Do we have a case here or is the Insurance company justified in being cheap and using a used Quarter Panel on a '2002 Honda Accord with about 15k miiles on it ? I want to hire a lawyer but would rather get some advice first. Thanks.

- I live in Maryland

-Insurance Company is Progressive Insurance

-Shop doesnt want to do the work if their forced in using a Used Q.P. and have stated they'd rather I get the job done somewhere else if thats the case, although i trust this shop.

-Adjuster has offered the shop a counter-proposal in which they can go with a new one if the shop is willing to give the insurance a 10% discount on the new part. The Shop refuses to because they feel they shouldnt be penalized for using the proper part the Insurance company 'should have' used to begin with. The shop said Used doors, fenders, etc. are fine, but they refuse to use Used major panels that require sectioning.

The attached link may or may not help (you didn't say whether the used part was an oem part or a knockoff). However, since it alludes to the practices Progressive Insurance follows regarding replacement parts I thought it might be of interest to you:

If not, then do a search at Insure.com and see if you can get your answer there.

I am not knowledgeable in auto insurance practices, just passing on a suggestion.
