Insurance does not settle

What is the name of your state? Colorado
In June of 2004, I was hit by a pickup truck from behind while waiting and stopped with my motorcycle at a red light. In October I requested that the insurance of the other driver start working on the settlement process. In early February of 2005 I was told that the records are complete and that the adjuster would be working on the settlement offer. In early March I sent my request for settlement officillay (typed letter) to the adjuster, explained my medical issues and how my life was affected by the accident and requested to hear from the insurance within 3 weeks from the date of receipt of the letter. This time has passed, the insurance has not contaced me with an offer and refuses to give me the liability limit amount. In order to get the doialog going, what do I need to do to file in court before the statute of limitation expires? Are there forms available that I can fill in to file with the court? What type of court would be responsible to handle such issue?

If you don't want to accept their offer your only recourse is to sue their insured. Even if you sue there is no guarantee of winning. You're call though. Insurance co.'s aren't obligated to give you policy limits. If you sue you will need a lawyer as the insurance co. will send one or two to defend their insured. It will also drag out f/ a couple years. A lawyer also takes a 3rd of your overall settlement and usually 40% if it goes to trial. This is also something to consider.
