| insurance refused to pay

Thank you in advance for nay assistance you can give me. My husband pulled over (in a parking lot no parking zone, hazards were on, not ticketed or noted on police report) due to car trouble. He was exiting the vehicle and was half way out of the vehicle when a car driven by an alderly man struck our car door. The other driver's insurance company is refusing payment because they said my husband should not have opened his door, he should have climbed over the seats and exited through the passenger side door. I could understand this statement if he were on the side of a highway, we were in a parking lot. Also the other driver has been unable to be reached by his own insurance company, so they don't even have a recorded statement from him. Is this a valid reason to refuse payment, can I sue? If I can sue, who do I take to court the insurance company ot the other driver?? |
