we were involved in a rear-end collision in august of last year. we were not at fault. we've obtained a lawyer for this incident.
we finally have a settlement for my now 6 year old son. there is a paper to sign about insurance subrogation - which was never mentioned. it states that when we sign it, the law firm is no longer responsible for insurance reimbursement. we contacted our lawyer (well, techinally the paralegal - never spoken to the lawyer, which i don't like) and he told us that the insurance had "put a lien against the law firm" which would cover the reimbursement of my son's claims. he claims that the settlement check is my son's - free and clear. this doesn't sound logical to me, but, thanks to ethics laws, i can't get any advice about this. i've contacted my health insurance - they didn't even know about this incident, and now they've got their own legal department handling the case. is this possible? i've never dealt with anything like this - and i'm at a loss! i don't want to do anything stupid to mess things up. i'd like to start my son a savings account with his settlement (which, i thought it was to be set up like that by the lawyer, seeing that he's only 6 - but the check is in my husband's name and mine. once again, that's a bit odd. a friend of mine was involved in something like this when we were in high school - everything was in her name, and couldn't be settled until she was 18. so i figured that my son's would be the same.). any input on this matter would be GREATLY appreciated! thanks!What is the name of your state? |
