Insurance wont insure their insured? YES! PLEASE HELP!


What is the name of your state?What is the name of your state? Illinois. Two weeks ago I was in an accident with a girl who flew through a stop sign. I hit her, but of course she is/was at fault. Her insurance company is Affirmative (out of Chicago) and i've been dealing with this pin head adjuster for the last two weeks. I feel like my car should have been fixed by now, but they are screwing around and putting me off. They tell me they have been unsuccessfull at contacting their insured. and untill they contact them I have to wait. They also tell me if they are unable to contact them my claim will be dropped and basically im screwed. If they were insuring these people isnt this their responsibility? I have liability on my car so my insurance company cant go after theirs. But reguardless, I didnt want to involve my insurance in the first place, its hers responsibility. My company tells me to wait it out, and if they drop the claim to sue...but thats a lot of work and extra time and money. There is an Illinois insurance investigation agency that would go after them I believe, but i'd just LOVE to know my options at this point. I have $3000 worth of damage to my car and I just want my money. Why do they have to make this so complicated? and If they dont contact that girl can they really just DROP my claim!?!

If they drop it, don't know that they can or can't then file a small claims suit for a few dollars and go after the driver. Then collectioning will be another issue!
