Insurer Delaying Accepting Liablity

I'm in Maryland, from West Virginia. I was in an auto accident Tuesday morning. My testimony and the OFFCIAL Police report confirm it was the other person's fault. The other person was also given a ticket for running a red light. The other driver's insurance if refusing to accept liablity pending consulting the witness listed on the police report. I do not have a rental car, I do not have transportation to my job during the week, and I do not have a vehicle for the 300 mile trip home on the weekends and it is clearly the fault of the other driver even according to the county law enforcement. Can the insurance company do this?
