intersection accident-word vs. word

What is the name of your state? PA. I was approaching an intersection as another vehicle ran a red light and ran into my vehicle damaging the front right fender and wheel area. He claimed I ran the light and I say he ran the red light. There were no witnesses who could prove this one way or the other. The only fact on the police report in my favor is the fact that he hit me. I am taking him to court based on this evidence but is this a strong arguement for my case? I feel that it proves that I occupied the intersection first.
