Hello Law experts out there,

Someone has crashed in
My car was parked then one guy was
intoxicated drove his SUV crashed into
my car.
My car has been declared a total loss in
the accident.

After sending papers and police report, I
got from the "H***** M*** Insurance" the settlement ammount:

NADA $ 2,715
* Less 20% as car is prior salvage vihicle - $543
Less old damage
- $100
Plus sale tax
+ 103
Less deductible
-500
------------------
Settlement
$ 1,675

Questions:
1. is NADA the only main source to quote ?

2. Why am I responsible for "deductible and
less %20 as car is prior salvage vihicle"
when I am not at fault ?

3. If you are in my shoe, what would you do ?

Well, I fight to the death on such matters even if the legal mandates are not on my side.

I ask for a new car (mid 15k) and start there. The insurance may ask to pay out x amount, so I sue the person directly if I feel they are able to pay (SUVs aren't cheap).

Otherwise, if the car is a total loss: I should get fair market value at the instant before the car was damaged/ruined.
