Residing in New York. Just received lawsuit papers today. My husband being sued for a motorcycle accident which he is accused of being at fault. What assests if any can plaintiff sue for? I have assests which were obtained prior to my marriage from an estate. Currently, all assests are in my name, aside from an ATV and a new truck, both of which are in my husband's name. I also purchased a summer home (in my name after we were married.) This purchased with assests obtained prior to marriage. I am worried that i will lose my assests due to this lawsuit. Should I worry and what exactly can i lose?

My response:

New York is a Separate Property State. Only assets in your husband's name are at risk. However, that doesn't mean that they can't go after his wages. Also, judgments are good for 10 years, and renewable for another 10 years. All judgments carry interest at the rate of 8 percent. So, this will effect you in a tangential manner. Make absolutely sure that you remove your money from any joint bank accounts. Do that Monday, no matter what.

Where was his insurance ? If he had insurance, have you informed the insurance company ?
