Just a passenger


What is the name of your state? Texas
My daughter was in a car accident in Texas with her boyfriend. He was the driver and had liability ins. only. He went to court and the court determined that it was not a case where the court could determine who was at fault. My daughter went to the emergency room to be checked out. Her bills are about $3000.00. Her boyfriends parents are saying that their insurance company will not pay her bills because he was not determined to be at fault. This has been going on for 8 months. Should we contact the insurance company ourselves to see if they are telling the truth? Or a lawyer? She doesn't have the money to pay the bills or for a lawyer. Thanks for any help you can give us.

yes, two cars. Boyfriend was going straight. Other car turning in front of him. Other car said he ran the traffic light. he said he didn't. Other car was in the turn lane out into the intersection. Heavy construction on the road with many blockades. Other car had a passenger that had a broken arm due to the accident. did I answer all of the questions? thanks for your response..

Liability coverage covers damages to the other car and injuries to the parties in the other car. Pip or med pay would cover injuries/loss of wages in the boyfriends car. (As would UM).He only has liability coverage---why do you think his insurance would pay anything out at all?

Passenger can file BI liability claim (in most cases) against driver of same car IF that driver is at fault. In this case, the parties can't agree as to fault but the passenger is DEFINITELY not at fault. Passenger is probably best off getting a lawyer as it may be necessary to sue both drivers and let the court sort it out.

Just got off of the phone with State Farm (drivers insurance co) and they said they would pay for her bills. Apparently the drivers parents did not want to file a claim so they told her that the ins. co. would not pay. (I am not positive about this but I suspect). State Farm agent was great in tracking down the particulars and could not have been nicer.
