What is the name of your state? What is the name of your state?OK My16 year old son who is a licensed driver was hit by a 14 year old unlicensed underage driver. The trooper ticketed both drivers. My son was stopped at the stop sign and started out because he thought he had time to enter the road. The other driver was speeding and slammed on her brakes when she saw the front end of his car. He tried to back up to get out of her way but she slid into his left front fender. I have a witness to the accident and my son did stop at the sign. The grass is very tall on this corner so his visibilty was impaired. The trooper didn't measure skid marks or even look at them upon his arrival as the 14 year olds aunt had parked on top of them when she arrived at the scene. My son had backed his car up about a foot from the actual point of impact. What is the law in OK on underage drivers and accidents. The trooper said each driver would be responsible for their own car damage. My son has liability only, so he is paying out of pocket. Also the other car had not been tagged for this year and insurance wasn't in the owners name. Also the trooper had come from 60 miles away to investigate the accident and didn't seem to take everything into account at the scene.

Nothing in your post suggests your son is innocent. The plain fact is you can't pull out in front of traffic regardless of whether the other driver is licensed, insured, speeding, etc. Police do not measure skid marks of minor traffic accidents, besides they are immaterial to the case. You could hire your son a lawyer but with the info you provided, it will probably be a waste of money.
