This is incredible. Do you mean to say that your former attorney has placed a lien on your settlement for fees, despite the facts as you have stated? If so, then yes, file for arbitration of the fee.
You're doing well to file a formal complaint with the Nevada State Bar. They will take care of him.
I would also consult another attorney to sue your former attorney for his malpractice.
The insurance company is, unfortunately, an innocent party in this matter. Until a court tells them otherwise, they can rely upon the settlement agreement that your former attorney agreed to on your behalf.
