liability obligations lie with???


What is the name of your state? Texas

I have a small landscaping business and one of my subcontractors totalled his truck. At the time one of my trucks was in the body shop for repairs which occured from someone hitting my car. There insurance was obligated to provide me with a rental vehicle and I loaned it to my sub. He jackkknifed a trailer on both sides of the rental, admitted it was his fault and provided me with his insurance co's name and number. Now the rental company needs a policy number and he is saying that he is not responsible and that since I have commercial auto insurance, its my responsibility. He says he didn't have insurance at the time but I know he did, they totalled his truck and he just bought a new one last week. My question is do I eat this one? My insurance co is telling me that in Texas if he was the driver that's enough, true or false?

Insurance follows the car, not the driver. Your employee's insurance will not cover this accident. You need to work with your insurance company on this one to see if you have rental coverage.

I didn't rent the vehicle


I didn't rent this vehicle, the insurance company that represented the guy that hit me rented it for me the papers were already filled out when I dropped my vehicle off at the body shop. I looked at the paperwork for the pick up and it says renters auto insurance company ON FILE. I did not provide them with any insurance information when I rented this vehicle.
