Lie about accident

What is the name of your state? California

Hello,

I am in a lot of major trouble that I should not be in. First, I was involved in a collision involving my car and a tree. The only problem with this is that I was not driving the car. It was late at night and we were going to pick up some fast food and come back to my house. This is when I made the worst decision of my life. I got a headache when I was driving so I pulled over and let my friend drive the car because the place was so close, and then I fell asleep in the passenger seat. Well the next thing I saw, we lost control and hit a tree. I was afraid that if my parents found out I was not driving, they would take away my car and I was also afraid that the insurance would not cover the damages. So what we (me and even the guy originally driving) told the police a different story that I was driving normally but the other guy distracted me by messing with my steering wheel randomly and we lost control. It has been about a month since this accident and life is getting worse and worse. On the police report, I have a bunch of violations against me and on top of that, I need to do community service and also my parents and I need to get counceling because the police there said my parents were not good parents for letting me out late (not true). My license might also be suspended due to the points coming out of all this.

My question is this --> Should I tell the truth? Or take a risk with my license and stick with this story? I will have the full support of the other members of the car at the time to confess about what happened. I am only afraid that my insurance will sue me for fraud (even though the fault was originally with the other guy to begin with) and that I will get an additional violation for evading the police. Or will everything clear?

Thank you so much for your help.

By not telling the truth to start with you only make things worse, you should do the right thing no matter what the outcome, now on top of what your insurance company might do you also face the risk of the police filing charges of makin a false statment, regaurdless of the consiquenses tell the truth you don't want this to haunt you the rest of your life.

What are the violations the police have named against you? Were you given a ticket or citation?

Is the only issue the damage to your car and maybe the tree?

Are you a minor? I am asking because you say you may lose your license.

Whether you or your friend were driving doesnt really matter to your insurance company at this point since under either scenario the carrier would still be paying for the property damage, EXCEPT

if the policy excluded all other drivers except the named insureds and added drivers.

Since you gave permission to your friend to drive, the insurance company wouldnt deny coverage since he is a permissive driver.

At this point I dont see what good would come out of the situation by everyone (you and friend) changing your stories.
