I am a resident of New Jersey & was involved in an accident in Pennsylvania. My car was rear ended by a tow truck & suffered extensive damage. I sustained injuries for which I am undergoing treatment.

My insurance policy has a limitation on lawsuit option, which prevents me from suing the party at fault unless serious injury was incurred by me. In other words I cannot sue for whiplash types of injury.

My question is:
Does the limitation on lawsuit apply for injuries that are incurred in out of state accidents & the at fault party is insured in the same out state (PA) ?
