| | | Loaned Our Car - Now It's Missing, HELP! What is the name of your state? Maryland
My husband loaned out our car. Today the guy he loaned the car to called him to say its "missing". At first he told my husband that "a guy that was at a party he was at last Monday night took the keys and the car, the guy's in jail and he can't find the car." So my husband calls the police to report the car stolen. The police contact the guy my husband loaned to the car too and the guy tell the police that the "car broke down and he left it on the side of the road." We've contacted both city and county looking for the car ... its not been impounded. The police are giving my husband the "runaround" cuz of jurisdictional issues (i.e. did the car go missing in the city or the county?) At this point, I don't know how to handle this. Is it the missing car the responsibility of the person to whom it was loaned? If it is not found, is it considered stolen? Do I report it stolen to my insurance or wait for the police to investigate?

| | | I'd report it to my insurance company if I had comprehensive coverage on the vehicle.

I'm really worried that the car may have been involved in something "untoward" and that the person who borrowed it is trying to cover up. I don't want anything the borrower may have done to come back to bite me on the a**.

| | | If you haven't already done so, definitely report the missing car to your insurance company. You have already reported it to the police. I believe that's about all you can do for now.

The county police say to report to the city and the city police say report to the county. Now the person who had the car is "gone missing" too! The county police have been going by their house every hour ... no one home and no one answers the phone. The police say they need a recorded or written written statement from them to make a report. What happens if I call the insurance at this point without a police report? I feel that since we've called the police we should get some kind of report. They're saying our alternative is to go to the courthouse and file for an arrest warrant. I was hoping that wouldn't be necessary, I just want a police report to so I can file my claim with the insurance company.

| | | You can file the claim with your insurance company without a police report. They will certainly ask WHY to haven't filed it, but it won't stop you from filing it. Why haven't you done that already? You seem to be eager to get your vehicle back, but not eager to notify your insurance company about a potential comprehensive claim which DOES NOT AFFECT YOUR PREMIUMS. I don't understand what you are looking for from us.

The problem is I don't have the details of who he loaned to car to. Thanks for your advice.

| | | Do you understand that reporting will not affect your insurance premiums in any way?

Since the borrower was being so evasive I'm very concerned that it may have been in accident that was their fault. If they are uninsured wouldn't it come back to my insurance?

But at least its done. Been a bad week -- son in a chain rear-end accident & car "lost". I kept praying that the car would turn up and I wouldn't have to report it. Been feeling a little overwhelmed. Guess insurance/police will take it from here.
Thanks to all for your advice. nlm |

| | | You can ask the police to fiile theft charges against the person to whom you loaned the car.
Of course, they are probably in Key West!! | |
