lost wages


What is the name of your state? pa How long does your own ins. company legally have to pay you work loss benefits after an accident? It has been a little over 2 months since my accident and I am back to work for 3 weeks now.

When you called your insurance company and asked, what were you told?

Well, 3 weeks after the wreck I called the ins. co. and they said they didn't know I was off work. Then they said they had 30 days after the wreck to pay my bills and my work loss. So I called them about 2 weeks later and they said they were waiting on paperwork and had 30 days. So 7 weeks after the wreck I called and they had all the info now. The agent told me they had 30 days fom the point they got all the paperwork. It seems like it's 30 days after each phone call I make. I guess if I don't call for another month I might get paid.

If they don't pay you, you have 2 years to file a lawsuit.

Well, they do have a right to an investigation, and I'm curious to know why you were off work for 2 months, but your insurarnce company wasn't aware of that. What injuries kept you off work for 2 months, and why weren't they notified? At this point, they can't even dispute the fact that you could have worked during those 2 months, know what I mean?

I was sitting in traffic and was rearended and pushed into another car. I sustained neck and back injuries. I am a lineman for a cable company and my job is very physical. I had disability slips from my doctor and chiropractor. My insurance company knew I was off work because I told them I was in the first conversation I had with them. Them saying they didn't know was just a story the lady was trying to tell me because they are dragging thier feet. I understand that I have a certain amount of time to sue them, I was wondering how long they legally have to pay me before I can take action. I really hate to retain a lawyer against my own company.

I understand exactly what you are saying, except this: In the very first conversation you had with them, you weren't working. How the hell were they supposed to know that 2 months later, you STILL weren't working? So, you've only had 1 conversation with your insurance company?

Look dude, no need to swear. i have been in weekly contact with my ins. co since the accident. I have been calling in regards to treatment and payments. My cousin works in the local ins office that I deal with and she has also been in contact with the adjuster handling my medical claim and lost wages. Believe me, I didn't just sit back and actually think my ins company would make progress on their own. I have bills to pay so I often called to check progress. The reference to the 2 weeks and 7 weeks was about the lady saying she had 30 days to pay.
