Malicious damage by vehicle


What is the name of your state? PA
Someone has been maliciously driving through our yard for years. The area he drives through is down a steep embankment, and the damage to the yard is obvious and just looks terrible. We can't repair it because he just drives back over it. He does it so randomly that we can't catch him in the act.
What can I do? If I see him do it and get his vehicle information, can he be charged with multiple counts of the damage or just that one time. Would it be better to secretly witness him do the damage on more than one occasion before taking action?
Please help! This has gone on for years. What are my legal/civil options?

I'm not sure this is exactly a legal question in regard to an auto acc. or vehicle claim. Anyway, have you reported this to the police? If you can get vehicle info (lic. plate # would be great), you can report that info to the police. They will then also have a record of you reporting damage previously.

Can you put up a fence? I mean, you're not even sure if it's the same vehicle doing it every time, right?

damage with vehicle


We have plenty of record of complaints--to local authorities, lots of neighbors who see it everytime, as well as PennDOT --we've contacted them numerous times, and they did put up some signs (it's on a sharp curve), but they said they couldn't put up a guardrail or anything more. And technically, it's still PennDOT's property because it's so close to the road, so we can't put up a fence.

someone suggested I post "No Trespass" signs---but do you really think that's necessary?? It's clearly personal property, and blatant malicious destruction. And the sign would have to be put on PennDOT's property!!

I would bet a large well place boulder would fix the problem.

Does the property Belong to you?

Why dont you install temperary Roadblocks like the police use, the ones with the spikes? I'm sure that they wont do it again!

Oh, I would LOVE to place a huge boulder there! I have fantasized about all sorts of revenge--stop sticks, a huge pile of bricks... It's terrible just letting the jerk get away with it. Kind of humiliating, actually. Can't he sue us if we do something like that? Everyone sues these days...

It's my parents' property. Yes, they own it.

Both your parents and Penndot cannot own the same piece of property. Either it's theirs and they can put up a fence or a boulder or whatever they want, or it's not and they don't have to worry about it. Wherever the line is between public and private property, that's where they can put the fence.
