Medical Lien


What is the name of your state? VT
I was in a car accident on work time 5 months ago. I have had 5 months of PT for neck strain/sprain (authorized by medical doctors all along the way). The person who caused the accident is uninsured and my auto insurance company (USAA) is telling me I can sue them (USAA) for damages.
My questions:
1) I understand I will have to reimburse my workers comp for medical bills. Do I mention this in my letter of demand? My concern is how much my damages will be reduced by having to pay workers comp back.
2) Is it true I submit my ACTUAL medical bills to my insurance company and not what workers comp paid to the medical doctors?
3)I was on anti-anixiety medication two years ago for a short period of time. Since my accident however, I have had to go on a much stronger medication. (the accident invloved four cars and one flipped in front of me and I was pretty traumitized having to go into oncoming traffic to avoid being squashed!)Should I include my doctor visits and medication?
I fear that they will say its pre-exisitng, but the truth is, I was fine with my anxiety and wasn't needing medication.
4) Do I include property damages in my demand letter? I mean will my own auto insurance company take what they paid already for my property damages out of my settlement?
